Abstract

The instability, previously conferred by Law 11.652 / 08, which consolidated the creation of the EBC and allowed interference in the public company, as well as a context of regulatory anachronism in the sector, already defined as uncertain the path of Brazilian public communication. With the beginning of the government of Michel Temer (PMDB) in Brazil, after opening a controversial impeachment process in the Federal Chamber in April 2016 and its consolidation in the Senate in August, EBC, especially in the figure of TV Brasil, was even more threatened. The dismantling process gained momentum with Provisional Measure 744/16, signed in September and consolidated by Law 13.417 / 17, in force since March. Considering this scenario, as well as the premise of public communication as a constitutional principle and its implementation corresponding to the best foreign practices, the discussion of the subject is more than necessary, it is urgent.
